Exhibit A "Pat Mannix Calls to WPWT 870AM": Dual Prosecution of Patrick J. Mannix, Sr.

If you regularly monitored both the WPWT 870AM "Good Morning Tri-Cities" and the WFHG 92.7FM "Marc Bernier Show" before October 2005, you might have noticed the regularity of telephone calls from political gadfly going by the name of Pat Mannix --- ever wonder what became of Mannix and why the Northeast Tennessee listeners of these programs are not hearing Mannix on the air?

I have never met with or spoken to Pat Mannix, but there are two significant legal paper trails between Mannix and both WPWT 870AM (d.b.a Information Communications Corporation) and WFHG 92.7FM. It appears that Mannix may have attempted too many calls into WPWT 870AM "Good Morning Tri-Cities" and the WFHG 92.7FM "Marc Bernier Show".

As it played out in Florida, Marc Bernier petitoned the Circuit Court of the Seventh Judicial Circuit, Volusia County, Florida (Case No.: 2005-33985 FMCI Division: 82) for "injuction for protection against repeat violence (after notice) pursuant to Florida Statutes 784.046 --- that is to say that the respondent, Patrick J. Mannix, Sr. made to many telephone calls to Bernier.

The Volusia County, Florida Seventh Judicial Circuit court records for the Bernier petition also reveal that an Order Allowance Appearance By Telephone was issued on October 10, 2005 by the distant court, so that "...the Witness, Matthew Hill,, may appear via telephone at the hearing scheduled for Tuesday, November 11, 2005 at 1:00 p.m. before the Honorable H. Pope Hamrick, Jr.

O.K., in Mannix's Florida circuit court trial, Tennessee State Representative and former WPWT 870AM talk radio host Matthew Hill was allowed appearance by appearance by telephone based on the the Petitioner Marc Bernier's Motion to Allow Witness to appear by telephone.

Forward up to December 23, 2205 to Sullivan Couny, Tennesee Law Court Part (I)(II), Case Number 12584 wherein Information Communications Corporation [d.b.a. WPWT 870AM et al] vs. Patrick J. Mannix, Sr. in which the notation on the bottom of the page states in part that the subpoena was served understate "...on the witness Marc Bernier Bernier...". Apparently, Mannix attempted to make too many telephone calls into two different WPWT 870AM radio programs.

Information Communications Corporation was represented within Case 12584 against Mannix by then Tennessee State Representative Jerome Cochran of Carter County, Tennessee. Exhibit A "Pat Mannix Calls to WPWT 870AM" provided to the Sullivan County Law Court by Information Communications Corporation, indicates that Pat Mannix attempted to call WPWT 870AM "Good Morning Tri-Cities" 521 times between September 5, 2005 and October 10, 2005 and also attempted to call the afternoon WPWT 870AM "The Local View" program 252 times between September 5, 2005 and October 10, 2005.

What Exhibit A "Pat Mannix Calls to WPWT 870AM" does not indicate if WPWT 870AM recorded calls were merely attempted calls (the WPWT 870AM phone bank would drop attempted calls after a certain number of rings), completed telephone calls into WPWT 870AM, or a combination of both attempted and completed calls by Mannix. Furthermore, Exhibit A does not break down the internal routing of these calls (e.g.: studio, office, management, etc).

What is perhaps more revealing about Exhibit A "Pat Mannix Calls to WPWT 870AM" (or troubling about the Sullivan County Law Court Part (I)(II) document) is the fact that this Sullivan County court exhibit as presented was apparently not a documented record obtained from the telephone companies servicing either WPWT 870AM or Pat Mannix (a Virginia resident) --- in my mind, when one party represented by an experienced attorney is charging a second party pro se with a criminal complaint of telephone harassment or similar offense, you would think that the presiding judge would want to insure that the court had access to actual telephone company records.

Exhibit A is not in any way marked by letterhead or other marks indicating that it originated from a telephone company , and as far as Exhibit A is concerned, I could myself produce a near-exact, laser copy of the Exhibit A "Pat Mannix Calls to WPWT 870AM" utilizing a layout software program such as Adobe Pagemaker...
