How To File A Broadcaster Complaint With The Federal Communications Commission

EB - BROADCAST COMPLAINTS
The Enforcement Bureau has two divisions responsible for handling broadcast complaints. The Investigations and Hearings Division is responsible for resolving complaints of non-technical broadcast violations such as complaints alleging broadcast of obscene, profane and/or indecent material, violations of the FCC's rules regarding broadcast of hoaxes, licensee-conducted contests, broadcast of telephone conversation, and public inspection file requirements.

The Spectrum Enforcement Division resolves complaints of technical violations such as unauthorized operation of a broadcast station, violation of the Emergency Alert System (EAS) rules, antenna structure registration, marking and lighting rules, and operation with excessive power or at an unauthorized location.

EB - Investigations & Hearings Division
The Investigations & Hearings Division is responsible for resolution of complaints against broadcast stations and other Title III licensees on non-technical matters such as indecency, enhanced underwriting, unauthorized transfer of control and misrepresentation. In addition, with regard to wireless licensees, the Division is responsible for enforcement of rules regarding auction collusion and misrepresentation. The Division also investigates industry allegations of violations of Title II of the Communications Act, as amended, and FCC rules and policies pertaining to common carriers. In addition, the Division conducts, or assists in, various other investigations being conducted by the Bureau and serves as trial staff in formal Commission hearings.

Functions
    Resolves complaints against broadcast and other Title III licensees.
    Investigates and takes appropriate enforcement action against common carriers for violations of Title II and FCC rules based on industry allegations.
    Serves as trial staff in formal hearings conducted pursuant to 5 U.S.C. § 556 regarding applications, revocation, forfeitures and other matters designated for hearing.
    Handles common carrier auditing functions.
    Investigates and takes appropriate enforcement action for violation of universal service requirements.

You can help us resolve your complaint more quickly by providing as much of the following information as possible: (1) the date and time the material was aired; (2) the call sign, channel, or frequency of the station; (3) the city and state where the program was viewed; and (4) as many details as possible about the content of the broadcast to help the FCC determine whether the material was obscene, profane, or indecent. You may support your allegations by a full or partial tape or transcript, or by providing a significant excerpt, but these are not required. The key is to provide enough information for staff to determine both the specific content of the complained-of material and the context in which it was broadcast. It is also helpful to include your address, e-mail address, phone number and time zone.

If you choose to submit a recording, you should send the recording to Federal Communications Commission, Investigations & Hearings Division/Enforcement Bureau, 9300 East Hampton Drive, Capital Heights, MD 20743. Any documentation of the programming becomes part of the Commission's records and cannot be returned.

On August 3rd Timmy Hill was on the radio saying he had endorsed David Davis and urged all of his listeners to vote for him. That may be an equal time violation.

He did get a job with David out of it.

How is the NRA different from Rolling Thunder? I'm not sure there fundamentally is any difference. I think this is especially true of the NRA Foundation.

Hill jr had the ability to endorse as a talk show host. Rolling Thunder is a 501 (c) 4...they have the ability to lobby, but not to endorse. Check the law.

We're not talking about Hill as a radio host. We are talking about the Federal requirement that the radio station offer every candidate equal air time, which the Hills have absolutely no interest in doing.

The Straw Man fallacy is committed when a person simply ignores a person’s actual position [in this case, Elmer's] and substitutes a distorted, exaggerated or misrepresented version of that position. This sort of “reasoning” has the following pattern:

1. Person A has position X. [how to file complaint with the FCC]
2. Person B presents position Y [posting against Rolling Thunder veterans group] (which is a distorted version of X).
3. Person B attacks position Y.["it is up to your bias]
4. Therefore X is false/incorrect/flawed.

Jeeze...youu really do need to stop listening to talk radio.

I believe someone has struck a nerve. Thanks for the FCC info. Could come in very useful, especially the way the Hills mix religion and politics. I can't figure out how the non-profit side owns part of the profit side. Does anybody know how that works???
So you give to Jesus through WHCB and part of it ends up at WPWT somehow. Doesn't AECC (WHCB) own like 49% of ICC (WPWT) or something like that. Sounds like an appeal to Jesus for funds, and then let's funnel it to the Repubican operation to me........ But what do I know.......

Exemption Requirements

To be tax-exempt under section 501(c)(3) of the Internal Revenue Code, an organization must be organized and operated exclusively for purposes set forth in section 501(c)(3), and none of its earnings may inure to any private shareholder or individual. In addition, it may not attempt to influence legislation as a substantial part of its activities and it may not participate in any campaign activity for or against political candidates.

To be organized exclusively for a charitable purpose, the organization must be a corporation, community chest, fund, or foundation. A charitable trust is a fund or foundation and will qualify. However, an individual will not qualify. The articles of organization must limit the organization's purposes to exempt purposes set forth in section 501(c)(3) and must not expressly empower it to engage, other than as an insubstantial part of its activities, in activities that are not in furtherance of one or more of those purposes. This requirement may be met if the purposes stated in the articles of organization are limited in some way by reference to section 501(c)(3). In addition, an organization's assets must be permanently dedicated to an exempt purpose. This means that if an organization dissolves, its assets must be distributed for an exempt purpose, to the federal government, or to a state or local government for a public purpose.

An organization will be regarded as operated exclusively for one or more exempt purposes only if it engages primarily in activities that accomplish exempt purposes specified in section 501(c)(3). An organization will not be so regarded if more than an insubstantial part of its activities does not further an exempt purpose. For more information concerning types of charitable organizations and their activities, see Publication 557.

The organization must not be organized or operated for the benefit of private interests, such as the creator or the creator's family, shareholders of the organization, other designated individuals, or persons controlled directly or indirectly by such private interests. No part of a section 501(c)(3) organization's net earnings may inure to the benefit of any private shareholder or individual. A private shareholder or individual is a person having a personal and private interest in the activities of the organization. If the organization engages in an excess benefit transaction with a person having substantial influence over the organization, an excise tax may be imposed on the person and any organization managers agreeing to the transaction.

I would suugest that Information Communications Corporation (d.b.a. WPWT, WABN, Mighty 1090, etc) constitutes a substantial part of the Appalachian Educational Communication Corporation (d.b.a. WHCB and the Cameo Theatre) activities as AECC owns 49% of ICC.

AECC owns 49% of WPWT 870 AM "Good Morning Tri-Cities. What percentage of the GMTC broadcast is dedicated to the advancement of parisan Republican politicians and the GOP legislative agenda?
